Kevin Connell, AccuScreen CEO and proponent of employer hiring rights, will unravel misleading quotes in a recent Associated Press article and clarify employers’ hiring rights in regard to pre-employment background checks.

TAMPA FL / August 23 2010 — Alarmed by the widely published Associated Press article from August 11th with the headline, “Some Job-Screening Tactics Challenged as Illegal,” AccuScreen has mounted a public response to counter statements that company leaders believe could misinform employers about their hiring rights.

In a webinar to be held Wednesday August 25 from 2 p.m. to 3 p.m. EST, Connell will unravel misleading facts in the article and explain employers’ hiring rights in regard to conducting a criminal background check and verifying the truthfulness of an applicant’s resume or job application.

Connell, the CEO of employment screening services company AccuScreen and outspoken proponent of employer hiring rights, believes the article is misleading and may have the effect of needlessly scaring employers about taking necessary steps to protect their companies.

“The article says that ‘companies using criminal records or bad credit reports to screen out job applicants might run afoul of anti-discrimination laws as the government steps up scrutiny of hiring policies that can hurt blacks and Hispanics’ — that is just ridiculous,” said Connell. “Employers have the right to ensure that they are hiring employees that will not jeopardize their company.”

“Employers cannot be made afraid to run a background check on applicants in order to protect their company, their employees, and their customers. In fact, laws have been passed making it mandatory to do criminal background checks in such industries as healthcare and daycare,” Connell said.

According to Connell, background checks can actually protect employers from being sued if an employee states he or she was fired or not hired because of illegal discrimination. “If the selection procedure has a disparate impact based on race, color, religion, sex, or national origin, can the employer show that the selection procedure is job-related and consistent with business necessity? An employer can meet this standard by showing that it is necessary to the safe and efficient performance of the job.” These guidelines, says Connell, comes directly from the EEOC.

Tenant screening makes it possible to protect your property by identifying problem renters

During the economic and housing crises, more apartment managers and rental owners are turning to rentals as a way to cover their costs. However, renting out property can be fraught with risks.

Over the past year, leading background screening expert Kevin Connell has noticed that more renters are fabricating credit histories and personal information to increase their chances of securing housing.

For that reason, real estate experts recommend that landlords run thorough background checks of prospective tenants before offering them a rental agreement.

Tenant screening is now a common practice for property managers across the country. Background checks enable landlords to weed out fraudulent applicants before they’ve moved into their rental properties.

U.S. Companies Report Alarming Increase in Employee Fraud

“Infinity screening” can protect businesses during the economic downturn, Accu-Screen reports

Chalk up one more negative consequence of the economic downturn: employee fraud and thefts are on the rise.

Employees facing increased financial hardships (such as having a spouse who was laid off, a sick family member or a home at risk of foreclosure) are more likely to take illegal actions to augment their incomes.

“The stress of these types of situations has lead to violence in the workplace, embezzlement and identity theft,” says Kevin Connell, chief executive officer and founder of Accu-Screen. “Employee larceny and other illegal acts can weaken or even ruin a corporation.”

In a February 19th Wall Street Journal article on this trend, Simona Covel reported: “Small companies are especially vulnerable because they often lack stringent internal controls to prevent fraud. Sometimes managers of affected companies attribute lost funds to lower sales – never even suspecting foul play.”

The following facts show how widespread this problem is:

* American organizations lose an average of 7 percent of their revenues to occupational fraud, according to the Association of Certified Fraud Examiners.

* The costs of fraud in the U.S. are estimated at $6 billion annually.

* Embezzlement has been the No. 1 financial crime for the past four decades; almost one-third of all company bankruptcies can be attributed to embezzlement.

* Fraud, identity theft and property thefts account for 60 percent of a company’s annual losses.

* Common employee frauds include false invoicing, check forgery, theft of cash and goods and setting up ghost employees or ghost vendors.

Many frauds are conducted by trusted long-term employees who are in positions of responsibility, such as bookkeepers and accountants. Companies should watch out for employees who are living a lifestyle that seems beyond their means, as well as employees who never take a vacation or try to prevent others from seeing the firm’s books or accounting software.

While most hiring managers understand the benefits of screening new hires, it’s less common for companies to continue screening their current employees. This can be a costly mistake. There is no guarantee that an employee who is hired with a clean criminal and credit record will remain that way.

Periodic credit and criminal background checks, also known as “continuous screening” or “infinity background screening,” have been shown to be effective risk management tools for companies and a major deterrent against potential fraud.

Fleeing fugitives are a growing risk in America

Recent news stories have reported that millions of criminals are escaping justice in America, and overworked police departments are doing little to pursue them. According to a recent investigative series in the St. Louis Post-Dispatch, between 1.9 and 2.7 million felony fugitives (including rapists and murderers) have eluded capture by crossing state lines.

Post-Dispatch reporters found a persistent problem with outstanding warrants across the country. If local or county police departments don’t enter all their warrants in the FBI database, fugitives not listed in the database can escape detection for their prior crimes.

* More than one third of all felony warrants are not entered into the FBI’s National Crime Information Center database checked by police across the country.

* Local police often refuse to pick up fugitives from other states, even when they’re wanted for violent crimes.
* The Senate Judiciary Committee recently passed the Biden/Durbin “Fugitive Information Networked Database Act of 2008”. This legislation aims to improve the identification, apprehension and extradition of felony fugitives.

Major retailers and other corporations are gearing up for the all-important holiday shopping season. Amid growing worries about stagnant holiday sales and signs of a recession, companies are still hiring seasonal employees. In their hurry to hire temporary workers, however, many companies run an increased risk of employee fraud, embezzlement and other crimes.

Accu-Screen, a leader in employment background screening, has found that employee theft and fraud tend to increase in a rocky economy. Accu-screen frequently conducts criminal and sexual offender background checks for retail chains and malls that are hiring seasonal employees.

“In uncertain economic times, more employees are giving themselves a ‘five-finger bonus,’” says Kevin Connell, chief executive officer and founder of Accu-Screen. “I’ve seen numerous recent cases of people who’ve decided to get a salary increase by stealing from their employers.”

Connell advises hiring managers and others to be on their guard when evaluating prospective employees. They should avoid giving in to the temptation to hire in haste, since they’re likely to repent at leisure, Connell says.

Some high-profile cases of seasonal crimes include:

* A New Jersey con man stole $200,000 from eight companies in four states. He repeatedly got hired as a store manager, worked for a few days or weeks, then disappeared with the cash receipts.

* Three Nordstrom’s security employees and a “secret shopper” were arrested for taking part in a retail theft ring that stole store merchandise valued at $62,000.

* An actor who worked as a mall Santa was arrested by Interpol for producing child pornography and abusing young boys.

Many of these employees looked good on paper, but were hiding a criminal record, false identity or a checkered employment history. Connell has noticed an upswing in people who are lying on their resumes this year. He saw the same pattern during the economic downturns in the late 1990s and after September 11th, 2001.

“It’s frightening how much damage a bad or dishonest employee can do in their first thirty days on the job,” Connell says. He recommends that employers protect themselves by doing background screenings of prospective and current employees.

In a segment to appear during the Fox 13 Late News, Kevin Connell of AccuScreen addresses the increased incidence of resume falsifications and provides advice for job-seekers and employers.

Felons Who Cross State Lines Pose Hiring Threat, says AccuScreen

Fleeing fugitives are a growing risk in America.

Tampa, FL October 20, 2008 — According to a recent investigative series in the St. Louis Post-Dispatch, between 1.9 and 2.7 million felony fugitives (including rapists and murderers) have eluded capture by crossing state lines.

Companies that unknowingly hire felons or fugitives put themselves at increased risk of embezzlement, fraud, lawsuits and workplace violence. Employers should be alert to the possibility that a fugitive criminal may be hiding in their workplace.

  • A statewide dragnet across Florida last month dubbed “Operation Orange Crush” led to the arrest of 2497 fugitives, including those of 113 homicide suspects, 255 sex offenders and 55 gang members. The U.S. Marshalls-led sweep targeted the “worst of the worst” offenders. According to the Post Dispatch report, 35 % of Felony Warrants in Florida are not entered into the FBI Database.
  • Organizers of Philadelphia’s “Fugitive Safe Surrender” program were astonished when 1205 felons turned themselves in at a local church in mid-September. The program was designed to encourage non-violent fugitives to settle their outstanding warrants.
  • More than one third of all felony warrants are not entered into the FBI’s National Crime Information Center database checked by police across the country.
  • Local police often refuse to pick up fugitives from other states, even when they’re wanted for violent crimes.
